Explanation

As per Order 1 Rule 10(3) of the Civil Procedure Code 1908, no person shall be added as a plaintiff suing without a next friend or as the next friend of a plaintiff under any disability without his/her consent.

This means that if a person is a minor or otherwise incapacitated, and needs a next friend to sue on their behalf, that next friend must be added with the incapacitated person's consent.

Similarly, if someone is added as a next friend for a plaintiff under a disability, their consent is also required.
