Rule 33(1) allows a procuring agency to reject all bids or proposals at any time before acceptance.
Under Rule 33(2), the agency must communicate the grounds for rejection to bidders upon request, but it is not required to justify those grounds to the bidders.
Under Rule 33(3), the agency must, upon request, communicate the reasons for rejecting all bids to the Public Procurement Regulatory Authority (PPRA).
Under Pakistan’s Public Procurement Rules, 2004, bidders submit separate sealed technical and financial proposals in one submission.
The technical proposals are opened and evaluated first to determine whether bidders meet the required criteria.
Financial proposals of only technically responsive bidders are opened afterward, while the financial proposals of technically non-responsive bidders remain unopened and are returned as prescribed by the rules.
